Boundary Surveyor

Adrian reached out to us following our query on Bark posted on a Friday evening. He was the first to respond and offered us a 30 mins free consultation. We contacted Adrian when we were presented with a letter from a RICS surveyor, which supported a claim from our neighbours over a strip of land which we knew to be ours. Adrian talked us through our various options, and thereafter guided us through our chosen course of action to commission a full land survey and present it to H M Land registry. It was regrettable that your neighbour happened to use a surveyor who, for reasons yet to be known, failed to undertake the work asked of him by your neighbour in accordance with RICS guidance and existing statutory provisions.

My clients - they are all very interesting people with a range of outlooks. I love helping them. As owner of the business and as a home owner myself, I can directly relate to residential clients in particular and see things from their perpective.

I got so tired of lining the pockets of other business owners, taking a sizeable profit from my efforts and leaving me with a modest salary. I know that I can work just as well, if not better, on my own initiative and can afford to give each client the time and attention appropriate to their need.

I care about your needs. I like to see a satisfied client, and I like to reassure and build confidence for those with building problems that need fixing. I try to avoid making things unnecessarily complicated. I try to explain things so that there are no misunderstandings. I am proud of my achievements in being able to serve, and solve issues for, my clients.

I can assist in some aspects of online and remote assistance. I can offer advice and support by telephone, and minimise the need to ask for cover of costs for trips to and from premises when it is possible to work remotely.

I follow all the standard protocols for safety concerning Covid-19. I don't want to catch it and I certainly would not wish to transmit it to my clients. I wear face masks, protective gloves, and carry both hand sanitiser and anti-bacterial sprays with me as part of my standard safety kit. My work does, of course, often bring me into contact with others in buildings that they own or are looking to purchase, so I am meticulous in maintaining safe working practices. There is a small impact on costs as a result of the additional precautions and PPE consumed during my work, but this has been kept under review and control.

We provide the RICS Homebuyer Report with Valuation and the RICS Building Survey for buyers looking to ensure that they have a professional opinion on anything that the building might throw up as a problem to be addressed before or shortly after purchase. We can also consider any advice you might need about potential scope for alterations you intend to carry out to the property to suit your specific needs.

If you have used the Help to Buy Scheme to purchase a new property and you are now approaching the end of the discount period, you will want to arrange to redeem the loan and transfer it to a remortgage of your property.

Your mortgage lender will usually provide a desktop valuation to assess the change in the loan you have on the property, but Target HCA will want an entirely independent RICS Red Book-compliant valuation of the property carried out.

We provide a prompt service, attending your property for an inspection and providing you the valuation report within two working days, which is the fastest permissible period allowed by RICS Regulation. A key element of the official procedure is the necessity for the valuer to carry out a study of comparable properties and to give a period of reflection on the true value before it is published.

It is also vitally important to ensure that the valuer compares the property as it was provided at the time of purchase and not to consider home improvements that were not funded by the original loan. Many modern houses are sold with basic equipment and finishes, with optional add-ons that are paid for outside of the mortgage loan. These must be properly listed and excluded from the valuation as special assumptions.

If you are finding it necessary to get a firm indication of where your property boundary is located, you have probably had a look at your Registered Title Plan and discovered that it isn't much help. At the typical scale of 1:1250 or 1:2500 a line covers a wide strip of land.

There is a tried and tested way of getting this boundary measured down to very precise dimensions and for these to be recorded permanently at Land Registry, but to do this you must follow certain steps to smoothly acheive this. You will need your neighbour to agree with you as well, which can actually be a little easier when they have a compelling report and accurate plan drawn up that shows where things ought to be.

Contact me today and I am sure I can help ease the burden of working out the way to resolve this WITHOUT either party involving solicitors. After all, finding a boundary is a surveying matter, not an essentially legal one.

The Party Wall Etc Act 1996 is often abused by so-called 'party wall surveyors', many of whom lack full professional accreditation and experience. Some prey on adjoining owners by reviewing the planning registers of local authorities and attempt to be signed up as appointed surveyors in advance of any notices being served by the building owners.

I am happy to trust in the system Parliament intended to run with this Act. Until a notice has been served (or perhaps requested from a concerned neighbour) there is no legal basis for any surveyor to declare himself as 'appointed' under the Act. The law actually states that a dispute has to have arisen (or deemed to have arisen to a notice) about work to which the Act applies BEFORE surveyors MUST be appointed to determine the matter.

I have, in the past, had to inform unscrupulous surveyors demanding fees and inventing disputes that they are not, in fact, protected by the provision in the Act that, once appointed, they cannot be removed!
