Act Early: Avoid Delays or Disruption to Your Construction Project!

At Berry Party Wall Surveyors we can serve Notice(s) on your neighbours should your building work include a new wall built up to or astride the Boundary or Line of Junction, you are obliged to serve a Party Wall Notice upon the neighbouring owners affected by the works. We can prepare and serve Party Wall Notice(s) on your behalf and advise you about the works that require Party Wall Notice(s) to be served on your neighbours.

Should your work include work on a party wall or party wall structure between two properties or a floor between two flats, you are obliged to serve a Party Wall Notice upon the neighbouring owners affected by the works. We can prepare and serve all necessary Party Wall Notice(s) on your behalf and advise you on the works that will require a Party Wall Notice(s) to be served on your neighbours

Should your work include excavations within 3 or 6 meters of an adjoining owners property to a greater depth than their foundations, you are obliged to serve a Party Wall Notice upon the neighbouring owners affected by the works. We can prepare and serve Party Wall Notice(s) on your behalf and advise you on the works that will require Party Wall Notice(s) to be served on your neighbours.

At Berry Party Wall Surveyors we offer Fixed Price Fees to carry out a Schedule of Condition Report & we strongly recommend that you have a Schedule of Condition compiled before your building project starts as this protects both you and your neighbours if there is damage as a result of the work being carried out.
When we inspect the Adjoining Owners home (your neighbours) we make a detailed report of the existing condition of the property that could potentially be affected by the work, taking careful note of any existing damage or cracks. The reason for doing this is so that claims cannot be made afterwards that the proposed building works are responsible for pre-existing defects to your neighbour’s property.

A Schedule of Condition Report will then be prepared in duplicate, one for you and one for your neighbour. This includes references to the photographs held on file and a detailed description of the current condition of the property.

PLEASE NOTE : Without a Schedule of Condition it is very difficult to defend a claim that the building works have caused damage to the adjoining property (or properties)!

At Berry Party Wall Surveyors we can prepare and serve a Party Wall Award (a legal document between you and your neighbours) if your neighbour does not consent to your building works and a dispute arises between you both. We can act as an appointed Party Wall Surveyor either for both parties, as the Agreed Surveyor, or both parties can appoint their own independent Party Wall Surveyor. The goal is the same, that is to prepare and serve an Award, which is basically a legal document setting out how the work will proceed, giving consideration to both parties.
