A Last Will and Testament or Will for short is a document that takes into consideration the wishes of the individual in regards to what happens to their estate (belongings, property, chattels and money...) in the event of their death.

This type of Trust is an effective way of ringfencing individual shares of the family home, this can be protected against potential attack from the local authority in the event of support being needed to to safeguard the long term needs and care of the individual.

A lifetime trust is the most effective way of protecting the property by removing it from the individuals estate. The trust property (Home) is held by the trust and its trustees, they protect the property for the owners enjoyment and also securing the long term inheritance for their family.

There are two particular types of LPA's

# Property and Financial Affairs
# Health and Welfare

In short these documents which are drawn up by the individual, pass the legal responsibility to there chosen Attorney's (often family members) to act as them. This type of service comes into its own especially when the individual loses their ability to make decisions for themselves (ie loss of their mental capacity) or their mobility is greatly impaired, thus having a registered LPA makes day to day living more palatable.

These products have really taken off in the last 10 years or so, they provide peace of mind that the costs of their own funeral is covered and capped against future funeral price rises. Possibly more important than securing the funds to pay for the service, is the details and arrangements for the day itself, remembering the more details that you record will leave less issues and unanswerable wishes behind for the family to deal with.

This is often an overlooked part of practical estate planning, by placing existing or new personal life insurance plans into a suitable trust. This means that the proceeds of the life insurance policy are paid out to the right person(s), at the right time without delay of probate and without any payment of inheritance tax guaranteed.
