We've had two wills from LCS now and on both occasions they were incredibly helpful. How anyone can offer a 10 minute will is beyond me. There are so many questions that come out of your meeting which you would have never considered by doing it online. A Will is a legal document that sets out what you would wish to happen upon your death.

Within your Will you will need to appoint Executors, these are the people you entrust to deal with all of your affairs after you die.

Within your Will you can list specific items that you wish to gift to people, you can also name guardians to care for your children should you die before they reach 18 years of age.

As well making provision for people, you can also exclude certain people from your Will.

Dying without a Will is called intestacy, this means that the law decides how your assets will be distributed rather than you deciding who you would like to leave things to.


Preparing a Lasting Power of Attorney (LPA) allows you the opportunity to make provisions in the event that you become incapable of managing your own affairs in the future.

The person(s) you choose will be known as your Attorney(s) and they must be over the age of 18.

When you have appointed your Attorney(s) you are referred to as the ‘Donor’.

When considering who to appoint as your Attorney(s) there are a lot of factors you need to consider so get in touch today.

Usually there are two types of LPA. Here at LCS, we offer our clients a third option:

1. The Property and Financial Affairs LPA: This allows someone to make decisions about your property and finances and can be used whilst the donor still has mental capacity and also when they have lost capacity. We recommend this as an essential option for all clients as it can be used when you are physically incapacitated e.g. following surgery or illness.

2. The Health and Welfare LPA: This allows someone to make decisions about your health and welfare. It can only be used when the ‘donor’ has lost mental capacity. Decisions regarding medication, surgery and life sustaining treatments can be made by your attorney with this LPA and future housing or care home placement will also be covered.

3. The Business LPA: This allows someone to make decisions about your business affairs and can be used whilst the donor still has mental capacity as well as when they are mentally incapable. We do consider this to be essential for business owners as it ensures the continuity of your business.

In order to apply for Probate at the Probate Registry, you will need to gather all information regarding a deceased persons Estate including:

- Bank Accounts
- Investments
- Debts
- Pensions
- Property and any other valuable items.

You will then to consider any outstanding debts or taxes owed by the deceased and then administer the Will in accordance with their wishes, ensuring all debts and taxes are paid.

There are some instances where Probate isn’t required; for example, when an individual had minimal savings or where they own property held jointly with someone else, in which case this property will automatically pass to the surviving joint owner.
