I’ve been putting off sorting out my will for ages, so when I finally pulled my finger out and decided to do it, I was hoping it would be an easy, stress free as possible process. Wills
You need to make a Will if you want to be absolutely sure that your estate goes to those you wish to benefit, and not whom the state has already decided upon on your behalf.
If you have children under 18 years old, Guardians need to be named in a Will. This is the only way you can deal with this otherwise your children automatically become wards of court, with the decision on their future being based on social service reports and made by people you don’t know and don’t know your children. They might not choose as you would. Imagine the enormous extra stress this would put on your children and relatives at a time of grief.
Common law partners must make a Will, as they may not inherit anything without one, even if they have lived together for years and have children.
A Will is one of the most important documents you can ever make and avoids uncertainty, anguish and long administrative delays, sometimes years, for those you leave behind.
However straightforward the circumstances are it is important that Wills are written properly to ensure that they are legally valid when the time comes as the very nature of the document means that it is too late to put things right after any problems arise!

But what happens if you lose the physical or mental capacity to manage your affairs while you are still living? By having a Lasting Power of Attorney you can make sure that you choose the people who control your legal and financial affairs together with your health and welfare should this occur.
If a Lasting Power of Attorney is not in place, no one could act on your behalf without the time consuming procedure of applying to the Court of Protection. They might not appoint the attorney that you would have. Even spouses or children can be left powerless.
