Dan Simon is really good at what he does. He is a master of transformative mediation and helps folks reach agreements by making sure that they have meaningful discussions. Dan also trains other mediators the transformative skill set. I recently had an excellent 4-day training taught by Dan and am already using this technique. I received a lot of value from Dan's transformative mediation class. I not only learned a great new negotiation legal skill, but I also understand conflict in my clients' divorce and custody cases and conflict in my personal life better. I've referred 3 people to him for training, and the class has been over for less than 2 weeks.In addition, Dan is an awesome transformative mediator. 2 or 3 years go, I sat in on 1 of his mediations because his clients asked me to write up their divorce agreements into divorce documents. Both parties spoke freely. They reached agreements on all case issues. More...

I attended Dan Simon’s mediation training workshop in L.A. in August 2018. This three-day program had a deeper impact on my work as an attorney and organizational development consultant than any other training or workshop I’ve attended. Dan was knowledgeable, engaging, approachable, humble, and had a great sense of humor. He is clearly committed to helping others transform their communications in times of conflict, and he demonstrated his own skills as an experienced mediator throughout the three-day workshop. In the weeks since the workshop, I’ve had an opportunity to use the Transformative Model in real-world settings, seeing firsthand how this approach helps empower others in expressing their own thoughts, ideas, and feelings while also becoming more responsive to others. I’ve also seen the other side: The day after Dan’s workshop concluded, I attended a mediation in Phoenix with a mediator who was not trained in the Transformative Model. As the mediator attempted to ‘guide’ the parties toward a resolution, and as the parties grew increasingly (and visibly) frustrated and disempowered, I kept thinking how different this might have turned out had Dan been mediating. I took Dan's three-day Mediation Training: The Transformative Approach in August 2018. I've known, liked, and respected Dan ever since we met through LinkedIn years ago. However I never fully understood how transformative mediation worked. I thought that the mediator's role was different from what I now understand. Dan is absolutely correct when he says, "It's not so obvious how powerful transformative mediation can be until you've had direct experience with it or a few days of training in it." Transformative mediators help people in conflict to change their conflict interaction by fostering empowerment and recognition and supporting the parties in their own perspective-taking and decision-making efforts. Two main tools transformative mediators use are reflecting and summarizing. Those tools allow transformative mediators help people in conflict become more self-aware and better hear and understand those with whom they are in conflict. As simple as this may sound, let me assure you that it is far from easy. Now that I fully understand the ultimate goal of transformative mediation and what transformative mediators do and don't do in order to effectuate that goal, I finally get it. I just completed Dan Simon's 3-day mediation training course and am still mulling over what I learned.  It was simple and complex, profound and obvious, easy and difficult.   With a humble approach, Dan sees disputes as when one or more of the parties involved feels weak and stuck.  He then shows you how to support the parties' conversation so that each can hear themselves and the other and thereby gain greater clarity about their situation.  This clarity empowers each of the parties to feel more in control and more willing to respond in a productive manner to the other.  The transformative shift is subtle.  But it is amazing how it changes your perspective. I have observed Dan as the mediator in several different sorts of situations. He is a gifted listener who truly and respectfully believes in self-determination. Most mediators are focused on nudging and even coercing or suggestively threatening the parties into reaching a settlement because most mediators consider a ‘win’ to be a settlement. Dan, on the other hand, is instead focused on helping the parties arrive at their own conclusions, and make their own decisions regardless of whether or not they are able to reach an agreement during the mediation session. This approach best serves the parties – especially parents in a divorce who will need to maintain some sort of amicable relationship throughout the lives of their children – because it gives them the opportunity to really ‘hear’ each other, and thereby craft a ‘solution’ to their issue(s) that is particularly and specifically best suited for them and their family members. I have heard many Judges tell parties that they are in the best position to make decisions about their own family, trying to encourage people to do so through an ADR process, rather than wanting or expecting someone from the outside looking in (whether that is a Judge or a guardian ad litem, etc.) to make the decisions for them through the court system. Unfortunately, most parties are then sent off to attempt an ADR process that does not actually allow them the freedom to creatively make their own unique decisions. Dan’s process is a breakout transformative process that leaves the parties with their dignity intact and ability to self-actualize their own best results. More...

I recently had the privilege of attending Dan Simon's Transformative Mediation training. This training changed the way that I view conflict and my approach to conflict resolution. Dan Simon is a natural teacher. I highly recommend this training to anyone wanting to learn how to deal with conflict, either personally or professionally. Dan Simon is a master at facilitating healing conversations between even the most contentious parties. As a marriage and family therapist, I am committed to helping divorcing couples terminate their marriages in a conscious and constructive way. Sadly, too many couples believe that the only way to "avoid getting screwed" is to hire expensive lawyers who will fight hard to get them a fair deal.What angry, hurting couples need isn't another fight, especially when there are children involved.
