DEATH WAIVER AND RELEASE OF LIABILITY FOR PROGRAM PARTICIPATION
I understand there are inherent risks in all aspects of physical training and I acknowledge that I have been informed of the possible strenuous nature of the training and the potential for undesirable physiological results including, but not limited to, abnormal blood pressure, muscle soreness, fainting, heart attack and/or death. I agree to WAIVE ANY AND ALL CLAIMS that I have or may have in the future against KF, and its directors, officers, employees, agents, volunteers and independent contractors (all of whom are hereinafter collectively referred to as “the Releasees”). I agree to RELEASE THE RELEASEES from any and all liability for any loss, damage, injury or expense that I may suffer, or that my next of kin may suffer as a result of my participation in the programs, activities and services provided by the gym, due to any cause whatsoever including negligence, breach of contract, or breach of any statutory or other duty of care. I agree to HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to the property of, or personal injury to, any third party, resulting from my participation in any program, activity or service provided by the releases.
By participating in this program, I am agreeing to all terms and conditions stated above and of Kayle Fitness and their fitness website Fitness Courses Adelaide | Best Weight Loss Programme (kaylefitness.com.au) I am aware this program has a performance Guarantee period of 6 weeks, and I must follow the program fully as outlined and ask for assistance when needed to claim it.
This agreement shall be binding upon me, my successors, representatives, executors,assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. Use of picture(s)/film/likeness: I agree to allow KF, its agents, officers, principals, employees and volunteers to use picture(s), film and/or likeness of me. In the event I choose not to allow the use of the same for said purpose, I agree that I must inform the gym of this in writing or over social media. If My program is ill-fitting for any reason I must inform KF within 14 days to cancel so they can stop making my plans for me. My plans and program go for a minimum of 16 weeks to make sure I can sustain my results long term
without assistance for years to come, however, if my fitness program is not working I’m aware I may claim a full refund for my plan at the 6 week mark and discontinue my training. I'm aware once I receive my plans I have 100% ownership of them and Kayle Fitness can't accept plans returned or as a reason for a refund being “I have not opened them” as we have no control of what you do
with them as they are all digital and can be copied or deleted at any time. Once your plan has been sent, it's your responsibility to let me know if you can access them correctly.
