LMIA is a document that an employer in Canada may need to get before hiring a foreign worker.

A positive LMIA will show that there is a need for a foreign worker to fill the job. It will also show that no Canadian worker or permanent resident is available to do the job. A positive LMIA is sometimes called a confirmation letter.

If the employer needs an LMIA, they must apply for one.
Once an employer gets the LMIA, the worker can apply for a work permit.

To apply for a work permit, a worker needs
• a job offer letter
• a contract
• a copy of the LMIA, and
• the LMIA number

How to get an LMIA

You’ll need an LMIA from Employment and Social Development Canada (ESDC).
The LMIA application process depends on the type of program you’re hiring through.

ELIGIBILITY

You must comply with all the Temporary Foreign Worker Program requirements for the position you are requesting. Learn about employer compliance and the possible consequences of non-compliance. You must also ensure that the employment you want to offer to a temporary foreign worker is for a full-time position which means that is has to be for a minimum of 30 hours of work/week.

This is a complicated application process required intensive information from you for our research and assessment.

PROCESSING FEE
$1,000

Families or individuals seeking to hire a foreign caregiver to provide home care for individuals requiring assistance with medical needs are exempt from paying the LMIA application processing fee. Families or individuals with a gross annual income of $150,000 or less, seeking to hire a foreign caregiver to provide childcare in their home to a child under 13 years of age, also qualify for the processing fee exemption.

This program is for skilled workers with foreign work experience who want to immigrate to Canada permanently.
If you’re eligible for one of the 3 immigration programs managed through Express Entry, you can also apply through Express Entry for the Provincial Nominee Program. If you’re nominated, you’ll get extra points so you can be invited to apply quickly.


ELIGIBILITY
You must meet all the minimum requirements to be eligible.
• skilled work experience: at least 1 year of continuous work or 1,560 hours total (30 hours per week) in Managerial jobs (skill type 0), Professional jobs (skill level A), or Technical jobs and skilled trades (skill level B)
• language ability: get a minimum score of Canadian Language Benchmark (CLB) 7 in all 4 abilities
• education: secondary institution (high school) or higher

6 selection factors: The current pass mark is 67 points.

These factors are part of a 100-point grid used to assess eligibility for the Federal Skilled Worker Program. You earn points for how well you do in each of the 6 factors.

The Canadian Experience Class is for skilled workers who have Canadian work experience and want to become permanent residents.

ELIGIBILITY
You must meet all the minimum requirements to be eligible.
• meet the required language levels needed for your job for each language ability
o writing
o reading
o listening
o speaking
• have at least 1 year of skilled work experience in Canada, in the last 3 years before you apply—you can meet this in a few different ways:
o full-time at 1 job: 30 hours/week for 12 months = 1 year full-time (1,560 hours)
o equal amount in part-time work: for example 15 hours/week for 24 months = 1 year full time (1,560 hours)
 You can work as many part-time jobs as you need to meet this requirement.
o full-time work at more than 1 job: 30 hours/week for 12 months at more than 1 job = 1 year full time (1,560 hours)
• have gained your work experience by working in Canada while under temporary resident status with authorization to work
You’re not eligible for the Canadian Experience Class if
• you’re a refugee claimant in Canada
• you’re working without authorization
• your work experience was gained without temporary resident status in Canada
According to the Canadian National Occupational Classification (NOC), skilled work experience means:
• managerial jobs (skill level 0)
• professional jobs (skill type A)
• technical jobs and skilled trades (skill type B)
Your work experience can be in 1 or more NOC 0, A or B jobs.
You must show that you performed the duties set out in the lead statement of the occupational description in the NOC. This includes all the essential duties and most of the main duties listed.
Self-employment and student work experience
Self-employment and work experience gained while you were a full-time student (even if you were on a co-op work term) doesn’t count towards the minimum requirements for this program.
Education
There is no education requirement for the Canadian Experience Class.
If you want to improve your rank in the Express Entry pool for immigration purposes, there are 2 ways you can do this.
• If you went to school in Canada, you can get points for a certificate, diploma or degree from a Canadian:
o secondary institution (high school) or
o post-secondary institution
or
• If you have foreign education, you can get points for:
o a completed foreign credential, and
o an Educational Credential Assessment (ECA) report for immigration purposes from a designated organizationshowing that your education is equal to a completed certificate, diploma or degree from a Canadian:
 secondary institution (high school) or
 post-secondary institution
Language ability
You must:
• meet the minimum language level of:
o Canadian Language Benchmark 7 for NOC 0 or A jobs or
o Canadian Language Benchmark 5 for NOC B jobs
• take approved language tests for:
o writing
o reading
o listening
o speaking
• describe the test results in your Express Entry profile
Your language tests are valid for 2 years after the date of the test result and must be valid on the day you apply for permanent residence.

ELIGIBILITY
You must meet all the minimum requirements to be eligible.
• meet the required language levels for each language ability. meet the minimum score of Canadian Language Benchmark 5 for speaking and listening, and Canadian Language Benchmark 4 for reading and writing
• have at least 2 years of full-time work experience (or an equal amount of part-time work experience) in a skilled trade within the 5 years before you apply
o your work experience must be for paid work (paid wages or earned commission—volunteer work or unpaid internships don’t count)
• meet the job requirements for that skilled trade as set out in the National Occupational Classification, except for needing a certificate of qualification
• have a
o valid job offer of full-time employment for a total period of at least 1 year or
o certificate of qualification in that skilled trade issued by a Canadian provincial, territorial or federal authority
Skilled work experience
Skilled trades for the Federal Skilled Trades Program are organized under these groups of the National Occupational Classification (NOC):
• Major Group 72, industrial, electrical and construction trades
• Major Group 73, maintenance and equipment operation trades
• Major Group 82, supervisors and technical jobs in natural resources, agriculture and related production
• Major Group 92, processing, manufacturing and utilities supervisors and central control operators
• Minor Group 632, chefs and cooks
• Minor Group 633, butchers and bakers
The major NOC groups are subdivided into different occupations, and they are all skill type B.
You must show that you performed the duties set out in the lead statement of the occupational description in the NOC. This includes all the essential duties and most of the main duties listed.
The work experience only counts after you qualified to independently practice the occupation.
There is no education requirement for the Federal Skilled Trades Program

ELIGIBILITY
I. FOR THE SPONSOR
You can become a sponsor if you are:
• at least 18 years old
• a Canadian citizen, a person registered in Canada as an Indian under the Canadian Indian Act or a permanent resident,
• living in Canada:
o if you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when your sponsored relative becomes a permanent resident.
o You can’t sponsor someone if you’re a permanent resident living outside of Canada.
• able to prove that you are not receiving social assistance for reasons other than a disability, and;
You must also be able to show that you can provide basic needs for:
• yourself,
• your spouse or partner,
• your spouse or partner’s dependent child(ren) (if applicable)
• your dependent child(ren) (if you’re sponsoring only your dependent child).
Note: In most cases, there is no low-income-cut-off (LICO) for spouse, partner or dependent child sponsorships. However, if either a spouse or partner you’re sponsoring has as dependent child who has dependent children of their own, or a dependent child you are sponsoring has a dependent child of their own, you must meet a minimum LICO score, which is determined by the Canadian government each year.
If you must meet LICO requirements, you must include a Financial Evaluation (IMM 1283) form with your application (see your checklist for more details). If you live in Quebec, you don’t have to submit this form to IRCC. See subsection 1(3) of the Immigration and Refugee Protection Regulations (IRPR) for more information.
If you live in Quebec, you must also meet Quebec’s conditions to be a sponsor.
Note: Maternity, parental and sickness benefits paid under the Employment Insurance Act are considered income. You can still sponsor, if you’re eligible, while on these benefits. Other payments, such as employment insurance and federal training allowances, are not considered income.
You may not be able to sponsor if you…
• are sponsoring a spouse or partner but you signed an undertaking for a previous spouse or partner and it hasn’t been three years since they became a permanent resident,
• previously sponsored someone and did not pay back any social assistance that they received while the undertaking was in place.
• are in default on an immigration loan or a performance bond
• did not pay court-ordered alimony or child support
• have declared bankruptcy which has not been discharged
• were convicted of
o an offence of a sexual nature,
o a violent crime,
o an offence against a relative that caused bodily harm or
o threatened or attempted to commit any of the above offences—depending on the nature of the offence, how long ago it happened and if you received a pardon
• are sponsoring a spouse or partner and you were previously sponsored as a spouse, common-law or conjugal partner and became a permanent resident of Canada less than five years ago,
• are under a removal order,
• are in a penitentiary, jail, reformatory or prison,
• have already applied to sponsor your current spouse or partner and haven’t received a decision.
Obligations as a sponsor
The sponsor must sign an undertaking, promising to give financial support for the basic needs of your spouse or partner and their dependent children, including:
• food, clothing, shelter and other needs for everyday living,
• dental care, eye care and other health needs that aren’t covered by public health services.
Before signing the undertaking agreement, you must make sure the people you sponsor won’t need to ask the government for financial help. If they receive social assistance, you’ll have to pay back what they received during the time you are legally responsible for them. You won’t be able to sponsor anyone else until you’ve repaid the amount.
The undertaking is a binding promise of support, meaning that it is your responsibility to support the applicant(s) for the length of the undertaking period even if your situation changes. The undertaking will stay in effect for the length of the undertaking period, even if your situation changes. The undertaking won’t be cancelled, even if:
• the person you sponsor becomes a Canadian citizen
• you become divorced, separated or your relationship with the sponsored person breaks down
• you or the person you sponsor move to another province or country
• you have financial problems
Length of undertaking
Your obligations as a sponsor start as soon as the undertaking is in effect. If you change your mind after you submit the sponsorship application and undertaking, you must write us a letter before a final decision is made on the file and submit the letter as an attachment through the IRCC Webform. You can only withdraw an undertaking if we approve the withdrawal. See Step 6 to find out where to mail your letter.
The length of undertaking for residents of Quebec is different from the length of undertaking for the rest of Canada. For more information about sponsoring a family member in Quebec, see detailed information for length of undertaking for residents of Quebec.
For sponsorships in all parts of Canada except for Quebec, the information below explains how long your undertaking will be valid.
You’re sponsoring a spouse, common-law partner or conjugal partner
Length of undertaking is 3 years from the day your spouse, common-law partner or conjugal partner becomes a permanent resident.
You’re sponsoring a dependent child over 22 years of age
Length of undertaking is 3 years from the day your dependent child (or the dependent child of your spouse, common-law partner or conjugal partner) over 22 years of age becomes a permanent resident.
You’re sponsoring a dependent child under 22 years of age
Length of undertaking is 10 years from the day your dependent child (or the dependent child of your spouse, common-law partner or conjugal partner) under 22 years of age becomes a permanent resident, or until the child becomes 22 years old, whichever comes first. The length of undertaking for residents of Quebec is slightly different.

II. FOR THE SPONSORED
Apply under the Family Class if:
• the person you want to sponsor lives outside Canada
• the person you want to sponsor currently lives with you in Canada but doesn’t plan to stay in Canada while the application is being processed
• you plan to appeal if the application is refused
• you’re sponsoring your conjugal partner or dependent child
Apply under the Spouse or Common-Law Partner in Canada Class if your spouse or common-law partner:
• lives with you in Canada
• has valid temporary resident status in Canada, or is exempt from needing this status under a public policy
• would like to apply for, and qualifies for, an Open Work Permit so that they can work while the application is being processed
Sponsoring your dependent children
You can sponsor your dependent children outside Canada who meet the following definition:
Definitions of dependent children
Your child or the child of your spouse or common-law partner can be considered a dependent child if that child meets the requirements below on the day we receive your complete application:
• They’re under 22 years old, and
• They don’t have a spouse or common-law partner
Children 22 years old or older qualify as dependants if they meet both of these requirements:
• They have depended on their parents for financial support since before the age of 22, and
• They are unable to financially support themselves because of a mental or physical condition
With the exception of age, dependants must continue to meet these requirements until we finish processing your application.
If your child’s age was locked in on or before October 23, 2017, a previous definition of dependent children may apply.
