If you are proposing building works, we will ensure that your obligations under the Party Wall etc. Act 1996 are satisfied. This includes serving notice on the owners of neighbouring property, appointing a surveyor, issuing a draft Award, preparation of a Schedule of Condition, and the necessary liaison required to reach conclusion of the Party Wall Award with their surveyor. However, if the owner of a neighbouring property proposes to carry out building works within close proximity to your property and/or you have received a Party Wall Notice from your neighbour or their Party Wall Surveyor, please contact us straight away and we will act on your behalf.
Crane & Scaffold Licences
We will advise on rights to oversail neighbouring property with scaffold or a crane. Depending on the works, scaffold may be granted under the Party Wall etc. Act 1996 if required to execute works in pursuance of the Act, otherwise the neighbour's express consent will be required, which they are not obliged to provide, can refuse to allow access, or may request monies and/or reciprocal rights.
Neighbourly Liaison
We will be the point of contact for a neighbour and deal with their queries and concerns so that building works can go ahead without causing any unnecessary inconvenience. We will also be in a position to advise both the developing party and affected neighbour of each other's rights, maintain good relations and prevent any misunderstandings.
Boundary Interpretations
We will provide our professional opinion on the status and ownership of walls, structures, and fences. The status will also determine rights with regard to works to that particular structure, including access rights in order to facilitate works close to, or on the boundary.
Schedules of Condition
We will prepare a detailed written and photographic Schedule of Condition of buildings and structures adjacent to propped building works prior to such works being carried out, so that any allegations relating to damage can be easily resolved.
