Services

Specialising in private child arrangement matters, we are well-versed in handling cases involving concerns about risk of harm, domestic abuse, and international jurisdiction issues.
We prioritise the welfare of the child and aim to reach amicable agreements without the need for court proceedings, considering mediation as a viable option.
Our firm is a member of Resolution, which is an organisation of family lawyers and other professionals that promotes a non-confrontational approach to resolving family disputes. Members of Resolution aim to consider the needs of the whole family, especially the children, and to avoid litigation.

The Divorce and Dissolution process in England and Wales has now moved to a 'No Fault' system and that means parties are now separating more amicably. At BWS Law we will advise you on your options and help you to navigate the process as quickly and as efficently as possible, keeping your communication in tact if that is necessary especially where children are involved. Divorce doesn't resolve the finances. See our Finances section for more information.

As the Divorce/Dissolution process does not dissolve the finances, but only dissolves the marriage, you will also need to consider how assets should be divided including houses, savings and pensions. Whether there should be any maintenance is also a key issue. We will advise you on your position and help you to navigate to a fair settlement to make sure that your needs are met moving forward. We can also help you obtain Court orders such as miantenance pending suit to ensure bills are paid whilst you are negotiating, or injunctions if you are worried assets are being wasted/moved.

Domestic abuse is a pervasive issue that transcends all sectors of society, affecting individuals regardless of sex, colour or creed. It is a serious concern that requires immediate attention and action. At BWS Law, we are committed to providing support and legal assistance to those affected my domestic abuse. That may be by sending a warning letter or applying for orders such as Non-Molestation or Occupation Orders.

We work closely with other domestic abuse organisations to help keep our clients safe and provide them with the support they need.

In recent years, there has been a noticeable rise in the demand for nuptial agreements, commonly known as prenuptial or postnuptial agreements. This trend is driven by various factors, including the desire for financial security, the protection of personal assets, and the increasing awareness of the legal complexities involved in marriage and divorce. Our expert solicitors understand the complexities of nuptial agreements and can ensure that the document is comprehensive and legally sound. Our team are well-versed in the latest legal precedents and can tailor the agreement to suit your specific circumstances, ensuring that it reflects your intentions accurately and protects your interests.

A Cohabitation Agreement, or a Deed of Cohabitation, is a legal document designed for couples who live together but are not married. It outlines the rights and responsibilities of each partner concerning property, finances, and other assets. This agreement is particularly useful in defining how assets and debts will be divided if the relationship ends, providing clarity and protection for both parties.

The agreement is prepared as a Deed which forms a type of contract between the parties setting out the terms that they will each adhere to during the relationship. We will advise you on your need for an agreement and help you get that in place to protect your interests.

Whether you are a separating co-habitee, co-owner of property with another family member or ex partner or you have a different issue about co-ownership, BWS Law can advise you as to your legal, financial and beneficial position. You may need to negotiate your exit from co-owning and/or sharing a mortgage, you may wish to sell a jointly owned property but the other person(s) don't agree, or there could be an argument over a promise that was made that the other person now isn't sticking to. We can help you reach a settlement or if necessary, get an order from the Court.
