Most of us will have considered making a Will at some stage, yet it is easy to put off making it, often due to the ‘will do later’ attitude. Many people presume their nearest and dearest will inherit what they leave behind, but your intended beneficiaries may not receive as you first thought. Unfortunately, if you die without a Will, your assets will be distributed according to an ancient 1925 law, rather than in accordance with your wishes. This could mean that the people you thought would benefit from your life savings will lose out in the long term, possibly causing them to suffer stress and financial hardship.

Hadleys Wills can assist you in making a legally valid Will which ensures that your wishes are followed and that your family’s future is safeguarded. We will work with you according to your personal preferences, whether you’d like to complete your Will online, by post or even in person. A Health and Welfare Lasting Power of Attorney (LPA) allows you to choose one or more people to make decisions in areas such as medical treatment. This Power of Attorney can only be used when you are unable to make decisions for yourself.

Within a Health and Welfare LPA, you are able to choose what you’d want to happen if you needed medical help to keep you alive when you no longer have the mental capacity to make the decision. This is relevant if you were to undergo life-sustaining treatment such as care, surgery or medication. On your LPA, you can either prevent your attorneys from having the authority to give or refuse consent to life-sustaining treatment, in which case the doctors will make the decision; or you can allow your attorneys to make the decision on your behalf. You can also state preferences and give your attorneys instructions as to what you would want to happen in certain situations.

A Property and Financial Affairs Lasting Power of Attorney (LPA) enables you to choose one or more people to make property and financial decisions on your behalf. You can specify if it comes into force immediately or once you no longer have mental capacity. You can also specify what powers your attorneys have.

If you give them authority, your attorneys can make gifts of your money or property, but this power is limited. However, the Court can authorise additional powers to make gifts in certain circumstances. If your attorney is making investment decisions, they should take specialist advice.

If you choose more than one attorney, you can allow them to act alone or require them to act together. If you state that your attorneys must act together, then the Lasting Power of Attorney will fail if either attorney dies or loses the ability to manage your affairs. To plan for this you should consider nominating a replacement attorney who could take over.
